Terms and Conditions – Happy Grips

Article 1 – Definitions  
In these Terms and Conditions, the following definitions apply:  
- Entrepreneur: The natural or legal person offering products to consumers at a distance, in this case: Happy Grips.  
- Consumer: The natural person not acting in the course of a trade, business, or profession who enters into a distance contract with the Entrepreneur.  
- Distance Contract: A contract concluded within the framework of a system organized for the distance sale of products, using one or more means of distance communication.  
- Cooling-off Period: The period within which the Consumer may exercise the right of withdrawal.  
- Right of Withdrawal: The Consumer’s right to withdraw from the Distance Contract within the Cooling-off Period.  
- Day: Calendar day.

Article 3 – Applicability  
These Terms and Conditions apply to every offer made by the Entrepreneur and to every Distance Contract concluded between the Entrepreneur and the Consumer.  
Before the conclusion of the contract, the text of these Terms and Conditions is made available to the Consumer via the website. Upon request, they can also be provided by email.  

Article 4 – The Offer  
The offer includes a clear and accurate description of the products offered.  
Obvious errors or mistakes in the offer are not binding on the Entrepreneur.  
Images of the products are for illustrative purposes only and may differ slightly from the actual product.  

Article 5 – The Contract  
The contract is concluded at the moment the Consumer accepts the offer and meets the stated conditions.  
The Entrepreneur will confirm receipt of the order electronically.  

Article 6 – Right of Withdrawal  
For detailed information about the right of withdrawal, returns, and refunds, please refer to our separate Returns and Refunds Policy available on our website.  

Article 7 – Prices and Payment  
All prices are listed in euros (€), inclusive of VAT and exclusive of shipping costs (unless otherwise stated).  
Payment must be made using one of the payment methods available during the checkout process.  
If advance payment is required, the order will not be shipped until the payment has been received in full.  

Article 8 – Delivery and Execution  
The Entrepreneur will take the utmost care in processing orders and delivering products.  
Orders are shipped to the address provided by the Consumer at checkout.  
Orders are generally dispatched within one working day. Should delivery be delayed, the Consumer will be notified.  
If delivery of an ordered product becomes impossible, the Entrepreneur will offer an alternative or cancel the order at no cost to the Consumer.  

Article 9 – Liability  
The Entrepreneur is not liable for damage caused by incorrect or inappropriate use of the products.  
The Entrepreneur is only liable for direct damage resulting from gross negligence or willful misconduct.  

Article 10 – Force Majeure  
The Entrepreneur is not obliged to fulfill any obligation if prevented from doing so due to circumstances beyond their control, including but not limited to supply disruptions, transport issues, natural disasters, pandemics, or government restrictions.  

Article 11 – Complaints Procedure  
Complaints regarding the performance of the contract must be submitted clearly and fully described via email within 7 days after the issue has been discovered.  
The Entrepreneur will respond substantively to the complaint within 14 days of receipt.  

Article 12 – Intellectual Property  
All content on the Happy Grips website—including text, logos, photography, and graphics—is the intellectual property of the Entrepreneur and may not be copied, distributed, or used without prior written consent.  

Article 13 – Governing Law  
All agreements and these Terms and Conditions are governed exclusively by Dutch law.  
Any disputes will be submitted to the competent court in the Netherlands.
